Emtee Agrees to Return Money Transferred from Family Trust Account

Multi-award-winning hip-hop phenomenon Emtee has undertaken to pay back the money he transferred from a family trust account without the consent of his estranged wife Nicole Chinsamy. This comes after Chinsamy obtained an urgent court interdict to prevent Emtee from depleting their estate and encumbering their assets in anticipation of their pending divorce.

According to Chinsamy, Emtee formed a trust during their relationship and appointed her, along with his friend and lawyer Dumisani Motsamai of Morolong Inc, as trustees. Chinsamy, as a trustee, received banking notifications on her cellphone. On May 2, she received a notification from FNB stating that R599,603 had been transferred from the trust account to a cheque account. Chinsamy claimed that only Emtee and Motsamai could have authorized such a significant transaction.

Alleged Motive

Chinsamy argued that Emtee transferred the funds to deplete the trust’s assets, ensuring that she would walk away with nothing once their divorce was finalized and the assets were divided. In response to Chinsamy’s concerns, the court granted her an order prohibiting Emtee from depleting the estate or encumbering any trust assets.

The court order stipulated that Emtee must return the sum of R599,603 to the trust account. It also interdicted Emtee from disposing, alienating, or encumbering any assets or funds of the Mthembeni Ndevu Trust. Both Chinsamy and Emtee were prohibited from using the funds for any purpose other than benefiting the trust beneficiaries.

Resolution and Communication

Emtee and his legal team expressed their willingness to return the funds to the trust account. They suggested that Chinsamy and her lawyer, Risiva Khosa, should have first contacted them to settle the matter out of court, rather than resorting to legal action. Emtee’s lawyer wrote a letter stating their agreement to return the money, on the condition that Chinsamy provided a reciprocal written undertaking to not utilize the funds for any purpose other than benefiting the trust beneficiaries until the divorce proceedings were finalized and the trust’s status was determined.

Confirmation of Fund Safety

Motsamai confirmed that the transferred funds were safely held in their FMB Attorneys Trust account. The funds remained intact and readily available. He mentioned that they could have provided the required undertaking on the same day if Chinsamy had directly contacted them.
