Kelly Khumalo has been accused of using the legal system as a tool for revenge against her ex-boyfriend, Molemo “Jub Jub” Maarohanye. Her failure to provide medical records and the police’s J88 form to substantiate her claims of r_ape and attempted murder has been highlighted by the rapper’s legal team as a key reason for dismissing the charges.

Last week, the National Prosecuting Authority (NPA) decided to drop the charges against Maarohanye, citing insufficient evidence to secure a conviction. This decision came after Khumalo, along with television presenter Amanda du-Pont and former radio presenter Masechaba Khumalo, accused Maarohanye of s_xual misconduct.

Incidents of The Alleged Abuse

In a police statement, Khumalo described an incident where Maarohanye allegedly pushed her against a wall and choked her while she was eight months pregnant with their son. She also recounted an episode in June 2010, after filming for Rhythm City, where Maarohanye allegedly slapped her following a confrontation outside the studio.

Khumalo further claimed that in 2010, Maarohanye punched her, causing her to hit a door frame and injure her nose. Another incident that year allegedly involved Maarohanye hitting her lip, leaving a permanent scar. Khumalo also accused him of assaulting her mother and sister at their family home in Vosloorus.

In 2012, Khumalo alleged that Maarohanye r_aped her after she refused to have sex with him, using a pillow to suffocate her. She also claimed he assaulted her again during a visit with their child, accusing her of infidelity.

Defense’s Argument and Lack of Evidence

Maarohanye’s lawyer, Ntsako Baloyi, submitted a representation to the NPA, arguing that the charges were an afterthought triggered by a podcast interview between Maarohanye and Mac G, in which Maarohanye made controversial statements about Khumalo.

Baloyi contended that Khumalo had no intention of reporting the incidents until after the podcast aired in December 2021. He argued that using the law to respond to feelings provoked by the podcast undermines its purpose as a tool for justice, turning it instead into a weapon for personal vendettas.

He urged the state to consider the lack of medical evidence and the delayed reporting, describing the charges as a smear campaign and vindictive ploy. He noted that none of the allegations were supported by medical reports, doctors’ notes, or clinical records, and attempts to obtain further details or medical corroboration were unsuccessful.

Baloyi’s representation concluded with a plea to the state to withdraw all charges to avoid wasting resources on what he deemed baseless accusations.
