WATCH | Free State High Court ruling on Dr Nandipha Magudumana’s arrest in Tanzania
The Free State High Court in Bloemfontein has dismissed Dr Nandipha Magudumana’s urgent application with costs. The application sought to declare her arrest in Tanzania illegal. Dr Magudumana was one of the seven individuals arrested for aiding and abetting the escape of Thabo Bester, a murder and rape convict, from prison.
Judge’s Ruling on Magudumana’s Awareness of Charges
In his judgment, Judge Phillip Loubser emphasized that Dr Magudumana was well aware of the charges she would face upon her arrival in South Africa during the handover process between the Tanzanian government and South Africa. The judge noted that she did not resist the handover process and expressed her desire to return to South Africa to be with her children.
Involvement in Handover Process
Judge Loubser further stated that Dr Magudumana actively engaged in the handover process. He concluded that if she had any concerns regarding the arrest, she should address them with the Tanzanian government.
Legal Arguments Presented
Last week, the court heard arguments from Dr Magudumana’s legal representative, as well as representatives from the Home Affairs and South African Police Services. The proceedings focused on the legality of Dr Magudumana’s arrest and her alleged involvement in aiding Thabo Bester’s escape from prison.
Magudumana was arrested together with her lover, Thabo Bester in Tanzania after being on the run from the police. The two are facing charges of fraud and defying ends of justice as well as the murder of a man whose body they used in Bester’s escape.
